Freelance Writers Contract

Have you ever wondered what a contract for freelance writing looks like? I normally perform project via verbal contract, but today I had a client actually ask me for a project contract. So I went digging around for sample contracts and then adjustmented one for my own use. the idea is to include certain project details and them provisions that protect boththe freelancer and the client in the event of problems.

This is what I came up with. (The exact details have been removed.)

FREELANCE AND XXXXX AGREEMENT

This agreement is made between ***** which conducts business at ***** , and name and name and is effective as of date. The Agreement covers project details , as per agreement by name on the following project.

Project name

The following terms and conditions are agreed upon by all parties:

Contract Period. name and name agree that this Agreement shall begin on the date listed above, and continue until date or the project is completed or, or until terminated by any party.

Compensation. name agrees to pay XXXXX to name and will render payments of pay timetable . name will submit an invoice to name weekly on or before XXXX before payment due date (See Attached Payment Schedule) via either hand delivery or U.S. postal mail or authorized freelance representative. A final invoice for XXXX will be submitted for payment to Name upon project completion and acceptance of project.

Freelance Financial Obligation. Name agrees that s/he is an independent contractor, and not an employee of any company. Name therefore agrees that s/he is responsible for reporting her/his own income to the appropriate authorities.

Relationship. name and name stipulate that this Agreement does not imply any other relationship between the two, and that any additional relationship desired by either party must be outlined in a separate Agreement.

Name owns all rights to content within the project upon fulfillment of this contract. Project piece will be supplied by name in which, name will receive name recognition and a total fee of XXXX for his/her contribution. (See additional required services)

Additional Required Services

Name agrees that name will perform XXXXservicesfor a fee of XXXX of which XXXX will be paid prior to the start of XXXX work or on date, whichever is sooner. Upon completion of sub-project, the remaining XXXX will be paid to NAME . Project payments via check or money order can be mailed directly to Name at_________ or given to Name or an authorized freelance representative for further mailing to name .

Thanks for this info. You have given me an idea of what constitutes the contract in freelance writing. I think this contract is necessary for both parties.

I agree with you. I'm not really a fan of them. But in this instance, this particular client has stiffed me in the past on verbal agreements. And this allows me to write in penalties for non-payment or failure to make payments, and gives me recourse to collect.

Ugh . . . ignore the typos. hahaha . . I was 4am when I put this up. Just to let you call know. All writers write badly. The difference is in the editing. LOL
